Judge accused of questionable judgement in dismissing cases

It remains unclear whether a South Florida judge accused of crossing the line will face any disciplinary action.

Miami-Dade County Judge Karen Mills Francis reportedly told defendants to show up with a present for a child, and in exchange she would dismiss their cases.

The State Attorney’s Office says Francis asked defendants in various misdemeanor cases to bring in at least $30 in toys for charity in exchange for the dismissal of their cases.

Four certified legal interns with the State Attorney’s Office allegedly took part. Three were disciplined, the other was fired.

A police officer who was fired from his job three years ago and eventually reinstated was arrested Wednesday for sexually assaulting a teenager he was investigating, authorities said.

Dwight Toombs was responding to a report that a 15-year-old woman and a 20-year-old man were having intercourse in a vehicle at Kimberly Bergalis Memorial Park on Dec. 18. Toombs, 33, handcuffed the man and the teen and fondled the girl, a complaint affidavit said.

Toombs has been charged with three felony counts of sexual battery on a person 12 years of age or older by a government agent and three felony counts of lewd and lascivious battery. He was being held at St. Lucie County jail on $900,000 bond.

“It’s disturbing,” Police Chief R. Sean Baldwin said. “It’s painful. It hurts. It’s embarrassing for the department. We work so hard to gain and maintain the public’s trust and to have an incident like this tears away at that. It’s hard on me and it’s hard on every officer that works here.”

Toombs, who was placed on administrative leave with pay Dec. 20., will remain on paid leave pending the review of an administrative investigation, according to a department press release.

The officer was fired by a previous police chief in 2004 after an internal investigation found he struck an 11-year-old child with a belt. City Manager Dennis Beach reinstated Toombs.

A Metro financial crimes detective is under arrest and facing multiple charges withdrawing at nearly $3,000 from the bank account of a man who sought police help when he had problems trying to refinance a home.

Police say an 86-year-old man and his 62-year-old daughter reported their identity stolen and were working with detective Eric Washington. The older man later discovered he was missing money from his bank account.

“The victim informed his own bank that unlawful transactions occurred on this account. He believed that the detective that he had been communicating with for his case had been responsible,” said Deputy Chief Ted Moody, Metro.

Police say Eric Washington faces charges including theft, attempted theft, burglary and fraudulent use of an ATM card. Washington’s suspended without pay pending completion of the investigation.

Police are reviewing all of Washington’s cases to see if they can locate any other victims. Washington is assigned to Metro’s Financial/Property Crimes bureau. If you are concerned, you can call 828-3620.

The Miramar City Commissioner turned himself in to police after pulling out a gun at a grocery store last month.

The Broward State Attorney’s Office filed a charge of aggravated assault with a firearm against Fitzroy Salesman this morning. According to reports, Salesman got into an argument and pulled out and pointed a loaded pistol at an individual in a Winn-Dixie on November 26. Salesman’s attorney said he was defending himself from an aggressor.

The charge is a third-degree felony with a maximum of five years in prison and a minimum mandatory of three years in prison.

Two Sheriff’s Department Employees Arrested

Two employees at the Hinds County Sheriffs Department have been charged with embezzlement.

Teddy Adams and LaQuanda Williams, both 26 and both of Jackson, were arrested December 10. Authorities say the pair stole gasoline for their personal vehicles.

Sheriff Malcolm McMillin says investigators believe the two stole more than $5000 worth of gas, but authorities are still investigating to determine an exact amount and if anyone else was involved.

A daughter of Atlanta Mayor Shirley Franklin pleaded guilty on Monday to helping launder money for her ex-husband, who is serving life in prison for his involvement in a drug dealing operation, prosecutors said.

Kai Franklin, 35, of Atlanta, entered the plea in federal court in Greenville, U.S. Attorney Reggie Lloyd said.

Franklin’s ex-husband, Tremayne Graham, was indicted in 2003 for conspiring to distribute at least 1,000 kilograms of Mexican cocaine from Los Angeles to Atlanta and South Carolina. After his indictment, Graham ran from authorities for three years until his arrest in June 2006.

During that time, Franklin paid $14,000 on the couple’s mortgage using more than a dozen postal money orders, Lloyd said. In court on Monday, Franklin admitted to structuring the transaction in an attempt to hide it from the Internal Revenue Service.

Graham was convicted of drug charges in April and is serving life in prison. At his trial, Graham’s co-defendants testified that Franklin received thousands of dollars in drug money, as well as portions of $150,000 in drug money invested in an airport concessions company run by her father, David Franklin, the mayor’s former husband.

Franklin faces up to five years in prison and a $250,000 fine for illegally structuring a financial transaction. She will be sentenced later, Lloyd said.

Cop suspended over allegations

A Philadelphia police officer charged in connection with an alleged home invasion in Pottstown has been suspended for 30 days with intent to dismiss, police said yesterday.

“We will not be saying anything further about Officer [Malik] Snell,” said Chief Inspector William Colarulo of Internal Affairs, referring further questions to the Pottstown Police Department.

Snell, a police officer since 1996 most recently assigned to the 18th District at 55th and Pine streets in West Philadelphia, is alleged to have driven the vehicle that fled after the home invasion, taking Pottstown Police on a high-speed chase before surrendering.

Yesterday, the Montgomery County District Attorney’s Office released new details regarding the arrest of Snell and his brother-in-law, Tyree Aimes. A third suspect, Stephon Gibson, is still at large, First Assistant District Attorney Risa Ferman said.

Ferman said yesterday that Snell was a conspirator in the home-invasion robbery late Sunday night in an apartment on South Roland Street in Potts-town.

“My understanding of this case so far is that Mr. Aimes and Mr. Gibson were looking to commit this attack of someone that they believe had stolen money from a drug dealer that they knew,” Ferman said.

“Mr. Snell drove the getaway car,” Ferman added. “However, the victims of the attack were not the intended targets.”

According to the affidavit of probable cause, after Aimes and Gibson barged into the apartment they believed was occupied by the people who owed the drug money, they roughed up an unsuspecting couple, then left. Snell drove his white Dodge Durango with Aimes in the passenger seat and led Pottstown police on an intense chase along Route 422 in Berks County.

Police arrested a nurses technician at a mid-state rehabilitation center for allegedly raping a resident.

Records show a Certified Nurses Technician (CNT) named 44-year-old Harvey Eugene Taylor raped a 70-year-old resident at the Madison Healthcare and Rehabilitation Center back in May.

A sex crimes officer and the TBI investigated the incident since it occurred and said the incidnet has not resulted in any othe rsexual misconduct allegations at the facility.

On May 5 the vicitm reported to staff members that Taylor raped her in her room. Emergency officials transported the victim to General Hospital, where a medical exam was performed.

DNA samples taken from her clothes matched Taylor’s DNA.

Taylor repeatedly denied raping the 70-year-old.

Police arrested Taylor Wednesday and charged him with aggravate rape. He is being held in lieu of $175,000 bond.

Friday, police announced that they had solved an armed robbery at the Westport Park Hotel Sunday night.

They’ve arrested 24-year-old Darwin Berry and 18-year-old Taira Richardson, both of the 1200 block of McCaslan in East St. Louis.

Police say they forced their way into the business area of the hotel at about 9 o’clock Sunday night. They were wearing masks and were armed, say police.

A clerk who was on duty was hit multiple times with a gun as he was forced to open a safe. He was then tied up.

Police say both suspects have admitted their roles in the robbery, and that they both have “prior association” with the hotel.

Both suspects are charged with robbery and armed criminal action.

The Westport Park Hotel is in the 2400 block of Dorsett in Maryland Heights.

Students said the people involved in the fight were friends and relatives of people involved in a similar altercation Thursday.

Witnesses said tensions were high at the school all day Friday. At one point, witnesses said, students were told people found wandering in the halls would be suspended.

As school let out, sources told Action News 5, Memphis Police were near the Northside High School campus because of a threat of retaliation after the fight Thursday. The fight started shortly after police moved on.

“It was like they waited until police left,” student Monica Flynn said.

The fight that broke out lasted only a few seconds, but Flynn said safety is always a concern.

“My safety is in danger,” she said. “I do think about it. So they need to quit it.”

Flynn said most students were happy it was Friday, and hoped tensions would calm over the weekend.

As the fight broke out at Northside, a similar altercation was playing out at Hamilton High School. Police at the scene would not comment, but took several people into custody.

State Rep. Thomas E. Wright, once a top lieutenant of former N.C. House Speaker Jim Black, turned himself in to Wake County authorities today following his indictment this week on charges of swindling banks, corporations and campaign contributors out of more than $350,000.

Wright appeared before a magistrate on the charges, which followed an investigation into his use of money meant for his campaign and for charity.

At one point, he looked at a cluster of clicking cameras and reporters and said, “You’d have thought I’d murdered somebody. Gee.”

Wright, 52, faces five felony charges of obtaining property by false pretenses and one felony charge of obstruction of justice. He was released on $50,000 unsecured bond, as ordered by Wake Superior Court Judge Donald W. Stephens.

Wright, a Democrat, is serving an eighth term representing his Wilmington district. He also faces ethics hearings in the General Assembly.

Late Thursday, House Speaker Joe Hackney appointed six representatives to a special ethics committee to hear the case against Wright. The House members are the same six who serve on the Joint Legislative Ethics Committee for both chambers.

Rep. Rick Glazier, a Fayetteville Democrat, is the chairman, and House Minority Leader Paul Stam, an Apex Republican, is the vice chairman of the special committee.

The hearings could ultimately result in Wright’s expulsion from the House. The last time the state legislature removed a lawmaker was more than a century ago, in 1880.

Former highway patrol officer accused of sexual battery

RALEIGH — A North Carolina Highway Patrol officer, who is accused of making sexual advances towards women he pulled over while on patrol, turned himself in to face the charges.

Stripped of his badge, his gun and his highway patrol car, a plain-clothed Michael Steele, Jr. walked into the Orange County Courthouse Friday.

Steele’s attorney spoke briefly to Eyewitness News.

“This is simply a first appearance, and we’re here to cooperate with the authorities,” Attorney Clay Plunkett said. “We understand there are some warrants. He’s here to turn himself in.”

The 28-year-old former officer faced a judge in handcuffs. Prosecutors say on three occasions in August, Steele pulled over women he believed were Hispanic immigrants.

He is accused of ordering the women out of their cars and driving them around Orange County. During the drive, authorities say he made sexual advances toward them.

“We thought this was a situation that was serious enough it warranted moving it directly to superior court,” Orange County District Attorney Jim Woodall said. “And we did it with sealed indictments because we wanted to get the defendant under arrest as soon as we could.”

As Steele’s wife and his father looked on, the prosecution read the list of charges. The charges include kidnapping, sexual battery, assault on a female and extortion.

Prosecutors say Steele even threatened to kill the family of one of his victims if she didn’t call him on a later date. Steele was a highway patrol officer for nearly four years and resigned from the force in September.

His bail is set at $250,000. The judge ordered him to have no contact with the victims.

Prosecutors say they will seek the death penalty against the man charged in the fatal shooting of two managers at Moe’s Southwest Grill in October.

Prosecutors say the evidence in the case will prove that there were aggravating circumstances that warrant the death penalty Derrick Gregory. He is accused of entering the Dilworth restaurant on Oct. 4 and gunning down Jeffrey Maher and Vinnie Ferens.

Gregory, a former employee at the restaurant, was arrested a short distance from the scene of the shooting.

Gregory’s next court appearance is scheduled for Jan. 24.

A Mojave High School student told police he “accidentally bumped” into shooting suspect, Nicco Tatum, which touched off a fight that eventually lead to six people being shot at a school bus stop on Tuesday afternoon.

Eighteen-year-old Nicco Tatum, who was on a bus on his way to Chicago, was met by police Wednesday night in Denver and arrested.

Metro had obtained a warrant for Tatum, charging him with six counts of attempted murder and six counts of battery with a deadly weapon with substantial bodily harm.

In the warrant, a Mojave High School student tells police that he accidentally bumped into Tatum while walking home from the bus stop on Monday. He told police that attempted to apologize to Tatum, but instead Tatum started a physical fight with him. He said Tatum had several friends with him and he was fearful, but he was able to get away and make it home.

The student said he was concerned about his safety and asked friends and family to meet him at the bus stop on Tuesday in case Tatum returned. He told police when he exited the bus on Tuesday, he saw Tatum and several of Tatum’s friends. He told police his friends were also there so he felt safe in leaving the bus.

The student said as soon as he got of the bus, Tatum and his friends moved toward him and then he heard gun shots. The student was shot in the leg as he attempted to runaway. There were also five other victims hit by gun fire.

Eastern Michigan University has agreed to pay $2.5 million to the family of Laura Dickinson, a student found dead in her dorm room last year, in a settlement announced this afternoon.

“Eastern Michigan University has reached an agreement with the Dickinson Family and Estate regarding the resolution of their claims. The Dickinson Family remains in the thoughts and prayers of the entire campus community,” said Don Loppnow, executive vice president and provost for EMU, said in a statement.

Dickinson, 22, was found dead in her dorm room last Dec. 15. Although university and police officials first said there was no foul play, fellow EMU student Orange Taylor III, now 21, of Southfield, was arrested and charged with her murder. He was tried in the fall, but a hung jury could ot reach a unanimous verdict and a mistrial was declared. A new trial is scheduled for next month.

Neither side will comment further per terms of the settlement, which was reached without a formal lawsuit being filed.

APPLETON, Wis. — Darshana Patel told authorities she was suspicious as she watched her boyfriend stir a smoothie at an ice cream store. When he offered it to her, she noticed powder on the cup’s rim, and the pregnant woman feigned illness and didn’t drink it.

According to a criminal complaint, the woman says she sent the powder to a laboratory and it turned out to be mifepristone, the abortion pill also known as RU-486.

The test results came too late: She had already suffered two miscarriages in less than a year.

On Thursday, Manishkumar M. Patel, 34, of Appleton, was accused of slipping the drug to the woman without her knowledge. He was charged with seven felonies and two misdemeanors, including attempted first-degree intentional homicide of an unborn child, stalking, burglary and two counts of violating a restraining order. The nine charges carry a maximum penalty of 99 1/2 years in prison and a $92,000 fine.

Wisconsin is one of 37 states with a “fetal homicide” law, according to the National Conference of State Legislatures. Under the 1998 law, anyone who attacks a pregnant woman and injures or kills her fetus could face life in prison.

“These allegations are devious, diabolical and disturbing,” Outagamie County Court Commissioner Brian Figy told Manishkumar Patel at a hearing.

Defense lawyer Thomas Zoesch said he had not had a chance to discuss the case in detail with his client but expects he will plead not guilty. No one answered the door at Darshana Patel’s Kaukauna home Thursday evening.

Darshana Patel and Manishkumar Patel are not related, and Manishkumar Patel is married to someone else; Patel is a common Indian last name.

The criminal complaint paints a picture of a long-running affair that produced a child, now age 3, but which soured.

The two had known each other since Manishkumar Patel, who holds a legal green card, emigrated to the U.S. from India in 1998, the complaint said. The two began a relationship in 2001 and had a son in 2004.

Darshana Patel said she became pregnant with Manish’s child in September 2006 — a child he denied was his — but she miscarried two months later.

She became pregnant with his child again in August 2007, the complaint said, and this time she noticed how attentive Manish became. He even prepared meals for her on occasion.

Then she noticed the powder on the smoothie cup at the store. A short time later, her doctor detected problems in her hormone levels, and she contacted the lab to test the substance in the cup. While waiting for a kit to test the substance, she miscarried. The lab test later confirmed the presence of the abortion pill, the complaint said.

She obtained a restraining order Nov. 13, authorities said.

The complaint said a search of Manishkumar Patel’s residence Wednesday found an envelope containing pills labeled as mifepristone, or RU-486. Investigators said they asked him if he knew what kind of pills they were, and he responded, “abortion pills.”

He told deputies he got the pills from India, according to the complaint. Access to RU-486 is strictly regulated in the U.S., and it is only administered to women in a doctor’s office.

Investigators asked him whether he used the pills to cause the miscarriages and he declined to answer. In a follow-up interview, he admitted giving Darshana “one pill” but did not say when or where, the complaint said.

Patel was ordered held on $750,000 bail after Assistant District Attorney Mark Schroeder said Patel had a net worth of $400,000 and was a flight risk. Patel runs service stations and other businesses.

Investigators had found an airline ticket in Patel’s home for a flight scheduled to leave for Germany on Nov. 28, the day after he was arrested, Schroeder said.

Jenni Crowley says she can’t understand why her son, a Marine reservist, is charged with murder in the death of an Iraqi soldier. Next week, she’ll be in California to watch his lawyers try to clear him.

The court-martial of Lance Cpl. Delano Holmes, 22, a graduate of Indianapolis’ Ben Davis High School, is scheduled to begin Monday at Camp Pendleton, Calif., where he has been held in a brig since February.

Holmes (pictured) is accused of fatally stabbing Munther Jasem Muhammed Hassin as the two men stood watch at a security post in Fallujah, Iraq, on Dec. 31, according to one of Holmes’ attorneys.

Holmes is charged with unpremeditated murder. Crowley and Holmes’ defense team say he was acting in self-defense.

“I can’t believe this,” Crowley told 6News’ Rafael Sanchez of the charge. “This is a nightmare.”

Steve Cook, one of Holmes’ attorneys, said earlier this year that Holmes and Hassin struggled in darkness after Hassin allegedly opened his cell phone and then lit a cigarette.

The men were not supposed to display any illuminated objects because of the threat of sniper fire, and Holmes made repeated attempts to make Hassin extinguish the cigarette, Cook said.

Holmes knocked the cigarette out of Hassin’s hands, and they started wrestling, according to Cook. Holmes thought Hassin was reaching for his loaded AK-47, so the Marine killed him with his bayonet and then radioed for help, Cook said.

Crowley said her son “has never wavered from the fact that he did not intend to kill this Iraqi soldier.”

“He facing the possibility of life in prison, based on the charges, simply for defending himself when he felt he had no other option,” Crowley said.

Crowley started a Web site to inform people about the case and raise money for Holmes’ legal defense fund.

Crowley will go to California for the court-martial, which is expected to last about two weeks.

“It won’t be easy,” she said. “It will be a very hard time again for our family and for Del, but I have to believe that the God I know and love and trust will see us through somehow.”

A local postal worker faced a federal judge this week in connection with throwing away mail.

Alvin Garcia-Jimenez, 28, is accused of throwing at least 300 pieces of mail into a Dumpster instead of delivering them. A witness contacted authorities.

Garcia-Jimenez was a temporary postal worker at the Azalea Park post office. Residents there were shocked by the news.

“That’s terrible,” one resident said. “We pay for them to get shipped and get to our familes and they don’t get there.”

This week, Garcia-Jimenez was arraigned in federal court on a misdemeanor count of obstructing the passage of mail entrusted to him as a letter carrier.

“This is a huge disappointment,” Postal Service spokeswoman Elaine Pancake said. “The postal service truly wants our customers to receive the service they expect and deserve and that out employees deliver.”

Garcia-Jimenez was released on his own recognizance.

Federal investigators said they believe all pieces of mail thrown in the Dumpster were retrieved and accounted for.

Commissioner charged for firearm violation

Police have charged a politician with a misdemeanor firearm violation after he allegedly pulled out a gun in a super market, sending customers running for cover.

Authorities arrested Miramar Commissioner Fitzroy Salesman the day before Thanksgiving after police said he brandished a gun on a shopper during a dispute at a Winn-Dixie supermarket. The argument took place at the Winn-Dixie near the corner of University Drive and Miramar Parkway.

When police arrived they said they found Salesman with a semi-automatic handgun tucked into the waistband of his black pants. Salesman told police that he and another store patron began arguing, and he felt threatened after the individual reached for his waistband. However, police said store surveillance video showed a different story.

According to the police report, the unidentified man in the video didn’t imply that he had a weapon, nor did he provoke Salesman.

This marks Salesman’s second arrest in the last three years. One month into his second four-year term, in April of 2005, Miramar police arrested Salesman for eluding authorities and on suspicion of driving under the influence. Governor Jeb Bush had him suspended from office.

On March 26, a jury acquitted him on the charges, prompting Governor Charlie Christ to reinstate him as commissioner four days later.

A Rocky Mount ape-man tried to find too good a deal on Black Friday: Police say he stole more than $5,000 worth of merchandise from stores at Cary Towne Center.

Cary police received calls about a suspicious looking man carrying things from a loading dock at the mall to his car. Officers ran the tag of the car and discovered it had been stolen.

When Paul Leon Lee, 40, noticed security watching him, he ran into the woods next to the mall, Sgt. T. Dezomits, with Cary Police Department, said. Police did not chase Lee, but waited for him in an unmarked car.

Lee came out of the woods and approached the car again around 8:45 p.m. Police went into arrest him, and Lee attempted to run but was caught, Dezomits said.

Inside the car, police found $5,000 worth of merchandise taken from various stores. Most of the goods were from the Children’s Place, Abercrombie & Fitch and Bath & Body Works. All the stolen merchandise was returned to the stores.

Lee was charged with felony larceny and possession of stolen goods.

BRUNSWICK COUNTY — A janitor at South Brunswick High School has been arrested for assaulting a student.

Camilio Dionicio is a 31-year-old temporary janitor at the school and has been charge with two counts of assault on a female.

Dionicio was released on a $2,000 bond.

A D.C. government official accused of stealing as much as $30 million in a property tax scheme asked a judge Wednesday for a court-appointed attorney because she said she has no money.

Federal authorities have seized a fortune in luxury goods, real estate and property receipts and other items from defendant Harriette Walters, News4′s Tom Sherwood reported.

In U.S. District Court Wednesday, Walters’ temporary attorney said she’s claiming she has no funds to pay for legal counsel.

Judge Alan Kay ordered Walters to fill out a confidential financial statement that he said will not be shared with prosecutors in order to determine how much money Walters actually has.

Walters also waived her right to be indicted quickly, pushing any indictment until Dec. 20.

Prosecutors said once she has an attorney, a possible plea bargain could be discussed in exchange for more information about the scheme that apparently existed for years.

Court officials said Walters was cooperative with authorities when she was arrested and since then, there have been “ongoing discussions with the government” about her case.

Her temporary attorney declined to comment.

The massive property tax scam has shaken the new Mayor Adrian Fenty administration and undermined confidence in the district’s long-serving CFO Natwar Gandhi.

But sources said the mayor is not willing to ask Gandhi to resign unless new information is revealed, and no council member has called for his resignation.

So far, 15 employees in the D.C. Tax Office have lost their jobs in this scandal.

A convicted killer, who spent more than two years on death row, was granted a new trial Wednesday by the Florida Supreme Court. Roy Lee McDuffie was convicted of killing two Dollar General Store clerks in Deltona in 2002.

It happened as the Dollar General Store was closing five years ago and family members are angry. But they’re not angry at the justice system; they’re angry at McDuffie, the man they still firmly believe brutally killed two women.

“I’m angry. I’m mad that it’s come to this. And I’m scared,” said Kelli Lee, the sister of one victim.

Kelli Lee got a call from the Florida Supreme Court on Wednesday morning, breaking the news that she would have to re-live the trial of Roy Lee McDuffie, the man who was on death row for killing her sister.

“A new trial means we have to see all of the gruesome and hear all of the gruesome stuff again,” she said.

It was October 2002 when Lee’s sister, Janice Schneider, and her co-worker, Dawnielle Beauregard, didn’t come home from work at the Deltona Dollar General Store. Investigators found the women in the back of the store, shot and stabbed, their hands and feet wrapped with duct tape and one piece of tape bore the palm print of McDuffie, a manager in training. Investigators believe his motive was robbery.

A jury convicted McDuffie, but the Florida Supreme Court said there were mistakes in his trail; the judge should have allowed one of his friends to testify, his defense should be have been allowed more cross examination of eyewitnesses and now he will get a new trial.

“It’s hard to carry the hatred with you all these years,” Lee said.

It is a disappointing turn of events for Lee, who said she’s been trying to forgive McDuffie, but won’t be able to until he’s put away for good.

“It’s all over again. It’s back on my shoulders again, because I’m going to have to go through this again,” Lee said, crying.

The State Attorney’s Office told Eyewitness News they are ready to go as soon as a trial date is set. The Florida Supreme Court still believes there is enough evidence to convict McDuffie, so in the meantime he is not getting out of prison.

A St. Louis County ape-man is facing a 13-count criminal charge for allegedly having sexual contact with students at the Lakeside Center, a juvenile detention center run by the St. Louis County Juvenile Court.

Bruce Germany is being sought by Maryland Heights police, who say the suspect was an employee of the St. Louis County Special School District, working as a teacher’s assistant at the juvenile center, which is located near Creve Coeur Lake.

Germany, according to police, was a longtime employee of the school district, and allegedly had sexual contact with two students.

The details of the case came out in April, according to William Wolff at the Lakeside Center, when there were “rumors” of some conduct by Germany.

The state child abuse hotline was called and a full blown police investigation began.

However, Wolff says that the school district fired Germany before the charges were filed.

Germany lived at a home in north St. Louis County, but neighbors say he hasn’t been seen in months. In fact, his landlord says he left owing him money.

Neighbors also say that Germany and a woman he identified as his wife also ran a day care center at the home.

His former landlord says the day care was licensed.

Neighbors say there were as many as five children in the home at one time, and Germany was sometimes there at the same time as the children.

Twenty years after her allegations of a racially charged rape became a national flash point, Tawana Brawley’s mother and stepfather want to reopen the case, a newspaper reported Sunday.

The Rev. Al Sharpton was an advocate for Brawley in the racially charged case that drew national attention.

Glenda Brawley and Ralph King want to press New York Gov. Eliot Spitzer and state Attorney General Andrew Cuomo to re-examine the November 1987 incident, which a state grand jury ultimately concluded was a hoax, the Daily News reported.

“New York state owes my daughter. They owe her the truth,” said Glenda Brawley. She reiterated her stance that her daughter was indeed raped by a group of white men who smeared her with feces and scrawled racial epithets on her body.

Representatives for Spitzer and Cuomo did not immediately respond to telephone and e-mail messages.

Brawley was 15 when she went missing for four days from her home in Wappingers Falls, about 75 miles north of New York. After being found, she made the shocking allegation that she had been abducted and raped by six white law enforcement officials.

The case quickly made headlines and drew the attention of the Rev. Al Sharpton, who became an outspoken advocate for the teen.

But a special state grand jury found evidence Brawley had fabricated her story. A former Dutchess County prosecutor who had been implicated in the case later sued Brawley, Sharpton and other Brawley advisers for defamation, winning a $345,000 judgment against the advisers and a $185,000 judgment against Brawley.

A spokeswoman for Sharpton, who was held liable for $65,000 in the case, did not immediately respond to an e-mail message early Sunday. The former prosecutor’s attorney did not immediately return a telephone message.

A former tester at a now-closed trucking school in West Plains pleaded guilty of Friday for providing fraudulent commercial driver licenses. Orbin May worked for the South Central Career Center Truck Driver Training School. May admitted he gave incomplete or inadequate driving tests. He also admitted fraudulently certifying that applicants had legitimately passed tests.

Two men from Somalia also admitted to participating in the conspiracy by transporting students to West Plains to obtain the licenses for large numbers of citizens from Somali and Bosnia.

Orbin Dale May, 64, of West Plains, and Ahmed Muhidin Sharif, 28, a citizen of Somalia living in Kansas City, Mo., pleaded guilty before U.S. Chief Magistrate Judge James England to the charge contained in a federal indictment on Sept. 20, 2006. Abdiwahab Mohamud Mohamed, 38, a citizen of Somalia living in Minneapolis, pleaded guilty on Nov. 1, 2007, for his role in the conspiracy.

The co-defendants each admitted they were involved in a mail fraud conspiracy from April 1, 2003, to Feb. 6, 2006, that defrauded others by denying the public the right of honest service of contract employees of the state of Missouri. The conspiracy involved fraudulent testing for commercial driver’s licenses on the part of the South Central Career Center Truck Driver Training School (SCCC) in West Plains. May was employed at SCCC, which at that time was a division of the West Plains School District, to train truck drivers and administer CDL driving tests.

A commercial driver’s license (CDL) allows a person to operate heavy commercial trucks – such as 18-wheel tractors and trailers – and buses on the public highways. In order to obtain a CDL, a driver-applicant must first pass a written test. If the driver-applicant passes the written test, he is issued a temporary permit and must then take the practical “skills test” or “competency test” administered either by the Missouri State Highway Patrol or a third-party tester, such as SCCC. This second test requires the driver-applicant to physically demonstrate his knowledge and ability to inspect and safely drive a commercial vehicle. These tests are required and regulated by both federal and state laws.

May admitted he gave incomplete or inadequate driving tests and fraudulently certified that applicants had legitimately passed the driving tests. During the course of the conspiracy and in furtherance of the conspiracy, May submitted fraudulent CDL forms, indicating that applicants had successfully completed the competency test, to the SCCC office, which then mailed them to the Missouri Department of Revenue. May would provide the applicant with a copy of the certifying document that could be used to obtain the CDL at a Missouri Department of Revenue office.

May also admitted that he received additional payment (above that which was required under law) to administer the tests, in order to ensure that applicants passed the CDL driving test.

Sharif participated in the conspiracy by transporting students from a truck-driving school to SCCC, knowing that May would fraudulently administer the competency tests. Sharif made about 15 trips in which he transported 70 to 80 students of Somali descent to West Plains in order to fraudulently obtain CDLs. Sharif knew the tests were being fraudulently administered by May, and observed May give incomplete or inadequate CDL driving tests to the students.

Mohamed, who had fraudulently obtained a CDL, directed students from the state of Minnesota in order to obtain fraudulent CDL licenses.

Under federal statutes, each of the three co-defendants could be subject to a sentence of up to five years in federal prison without parole, plus a fine up to $250,000. Sentencing hearings will be scheduled after the completion of presentence investigations by the United States Probation Office.

A tribe of nappy-headed ho’s in Lake County are accused of breaking into a Dollar General Store and stealing thousands of dollars worth of merchandise in an apparent attempt to get even with a manager of the business.

“The assistant and another lady were mad at the manager for some unknown reason and no one knows why — the manager doesn’t even know why — and they were going to get even with her,” Fruitland Park Police Chief J.M. Isom. “Even was taking the merchandise to make her stock come up short.”

Investigators said Asst. Manager Melinda Brown and Quanesha White were apparently fed up with their minimum-wage jobs at Dollar General and enlisted the help of Josephine Edwards and Caroline Goldwire to break into the store located in Fruitland Park.

The women were taken into custody after $2,500 worth of food, toiletries and toys from Dollar General were found in a van Saturday night, police said.

Officers said the women did not have any receipts, but had keys to the store that had been closed for about an hour.

“When you work a shift, night shift or day shift, you come to learn your surroundings and you know when a store is closed that there is not supposed to be someone around the back of the building,” Isom said.

The four women were charged with grand theft and conspiracy.

Jury being selected for trial of woman charged in connection with Jessie Davis’s murder

CANTON — Lawyers in Canton today are narrowing a pool of 73 possible jurors for the trial of a woman charged with concealing what she knew about the killing of a pregnant woman and an attempt to dispose of the body.

Thirty-year-old Myisha Ferrell of Canton is charged with obstructing justice and complicity to gross abuse of a corpse.

Her trial in Stark County Common Pleas Court is expected to start Monday, with opening statements. Ferrell faces up to six years in prison if convicted on both charges.

Ferrell’s trial likely will reveal some of what investigators believe happened to 26-year-old Jessie Davis.

Thirty-year-old Bobby Cutts Junior is the former Canton police officer accused of killing Davis.

Davis was nine months pregnant when she vanished in June, sparking a search that drew national attention. After several days, her body was found in a park.

Cutts went to high school with Ferrell. Prosecutors allege Cutts enlisted the help of his high school classmate in helping to dispose of Davis’ body.

Two Shot & Killed at Moe’s Restaurant

At 2:43 this afternoon, CMPD officers responded to Moe’s Southwest Grill located at 1512 East Boulevard (Dilworth area) in reference to a shooting which occurred inside the restaurant. Two men were shot and both died as a result of the shooting.

At the time of the shooting, Mecklenburg County Sheriff Deputies were conducting a funeral procession escort when one Deputy was flagged down by a witness who advised him of the shooting. Other Deputies & CMPD Officers responded to assist. The suspect was arrested by a Sheriff Deputy a short distance from the shooting scene.

Deputies and Officers discovered two men shot inside of the restaurant. Vincent Patrick Ferens (Top) was transported to Carolinas Medical Center and died shortly after arrival. Jeffrey Philip Maher (Middle) died at the scene. Vincent Ferens was a Managing Partner at Moe’s and Jeffrey Maher was an Assistant Manager.

The suspect, Derrick Lamont Gregory, (Bottom) was a former employee of Moe’s who was fired from his job several weeks ago. At the time of the shooting, the restaurant was occupied by several customers but nobody else was hurt during the shooting. Gregory has been charged with two counts of Murder.

Derrick Gregory does not have a criminal record in North Carolina and he was issued a gun permit in Mecklenburg County in March. Police say they were called to Moe’s on September 13th, the day Gregory was fired. Apparently, he did not leave silently and caused a big ruckus on his way out the door. He was not arrested and left when officers arrived.

JaMorris Brandon Walker, 18, was arrested Tuesday for the murder of 18-year-old Zeric Harrison. Harrison was killed last weekend.

Walker was taken to Orlando police headquarters and being charged with first-degree murder.

Orlando police arrested a man who was spotted trying to steal from a city fire station early Wednesday.

A witness spotted a man inside the building on South Westmoreland Avenue at about 2 a.m. A police officer later found Larry G. Shingles, who matched the suspect’s description, in the area.

The officer had to chase Shingles down on foot to arrest him. He was taken to Orange County Jail, under charges of burglary and resisting arrest without violence.

Man Arrested after Setting Fire to Apartments

Early Saturday morning, Charlotte Fire Department responded to an apartment complex on West 26th Street after two fires were intentionally set. No residents were hurt in the fire.

Police arrested James Otis Gladden at the scene of the fire and charged him with fire degree arson, malicious use of explosive damage property and misuse of the 911 system.

His bail was set at $55,000.

A transient who robbed another man after asking him for a cigarette was arrested in front of the Central Florida Coalition for the Homeless shelter early Wednesday.

Orlando police said that Weston Jackson asked a 46-year-old man for the smoke in the 900 block of West Central Boulevard, but then snatched money from his hand and fled.

Police later found Jackson, 42, in front of the homeless shelter.

Jackson was taken to Orange County Jail, under one charge of robbery.

Orlando police, dispatched to a burglary at an occupied home, caught the thief walking down the street carrying his haul Tuesday night.

Officers were on their way to the reported crime at 621 W. South St. when they spotted a man toting a TV near Terry and Anderson streets.

Police arrested 50-year-old Johnny Howard on the spot.

He remained in Orange County Jail on Wednesday, on a charge of attempted burglary.

More Charges for Former CMPD Officer

Former CMPD Officer LeShunda Austin was arrested again yesterday and faces three additional charges related to her filing a false police report earlier this month.

The additional charges include; filing a false police report, obstruction of justice and accessing a government computer in an attempt to defraud.

JEW YORK – A former medical examiner’s office employee admitted to running an elaborate scheme in which he and a subordinate stole millions of dollars meant to identify the victims of the World Trade Center attacks.

Natarjan Venkataram pleaded guilty in Manhattan federal court to 16 charges, including embezzlement and money laundering. His partner, Rosa Abreu, last week pleaded guilty to charges of embezzlement, money laundering and conspiracy.

Abreu was the director of records at the medical examiner’s office, and Venkataram was her boss. They resigned in 2005.

The two, charged in 2005, steered more than $13 million in computer service contracts and purchase orders between 1999 and 2004, in exchange for cash kickbacks to companies that did little or no work.

More than 250 Jacox Elementary School students received handshakes, medals and a chance to win prizes this fall at the school’s annual ceremonies recognizing success on state standardized tests.

The adults got something, too: Cash – $10 for each test their third-, fourth- or fifth-grader passed.

The idea? To thank parents for helping their children do well in school.

“I was shocked,” said Cheryl Wiggins, who received $20 for her son’s performance on the exams. “At first I’m like, ‘Well, I didn’t do it.’ Then I thought, ‘Sure, I did do it.’ “

It’s not uncommon for schools to provide parents with gift certificates or prizes as an incentive to become more involved. Offering adults money for a child’s academic achievement is rare, though.

A Mexican program that gives cash grants to families for keeping children in school and giving them medical care has been so successful that New York Mayor Michael Bloomberg is trying something similar.

Experts say they support the concept if it reinforces parents’ role in a child’s education – and if it’s seen as a morale booster rather than a payment.
