The man accused of murder and armed robbery in the death of a video game store manager has a criminal record going back more than a decade and a string of aliases.
Patrick Gray Graham, 34, was arrested early Wednesday morning at the Skyway apartments on South Cobb Drive in the death of Matthew Cherry.
Marietta police found Cherry, manager-in-training at the GameStop just off Cobb Parkway, unconscious and not breathing Sunday evening. Cherry, 21, was pronounced dead at WellStar Kennestone Hospital.
According to the arrest warrant, Graham bound Cherry’s face, hands and feet with duct tape, placed Cherry “in a closet in the store and waited until he had stopped breathing before he left.” Two other people, store employee Luis Gallegos and his father Jose Gallegos, also were bound with duct tape. They were treated at the scene.
Matthew Cherry’s father, Edwin Cherry, was weeping Wednesday after he received the news of Graham’s arrest. “It’s such a senseless act,” Edwin Cherry said. “You look for some reason in things like this. I guess we are not supposed to understand why. I’m glad the police found him.” I just hope no one else has to go through this.”
Graham is accused of stealing video games, game systems and accessories from GameStop and money from Cherry, Jose Gallegos and Luis Gallegos.
Graham is charged with murder, three counts of kidnapping, three counts of false imprisonment, three counts of armed robbery and possession of a firearm during the commission of a felony, according to the arrest warrant.
Graham was arrested in March 2006 for selling $100 worth of crack cocaine to an undercover police officer. He pleaded guilty to one count of felony drug sale before Assisting Superior Court Judge Frank Cox in March and was sentenced to five years on probation, according to court documents.
Graham’s criminal record includes a 1995 forgery conviction and a 1996 conviction for obstruction of a police officer. In 1997, he was convicted for felony drug sale, for which he was also sentenced to probation. But the probation was revoked after he was picked up on drug charges and sent to prison. Graham was released in April 2002, according to the Georgia Department of Corrections.
